Welcome to Bambu Travel ("we," "us," or "our"). By accessing or using our website, https://travelchina.tips and https://tour.travelchina.tips (the "Site"), and any services offered through the Site, you agree to be bound by these Terms and Conditions (the "Terms"). Please read these Terms carefully before using our services.

2. Acceptance of Terms

By accessing our Site, registering an account, making a reservation, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our Site or services.

3. Service Description

We provide an online platform for international travelers to book travel itineraries, accommodations, and related services for travel to China. We act as an intermediary between you and the actual service providers (hotels, tour operators, transportation companies, etc.).

4. User Accounts

4.1. To access certain features of our Site, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process.

4.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4.4. We reserve the right to suspend or terminate your account at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

5. Booking and Reservations

5.1. All bookings made through our Site are subject to availability and confirmation by the relevant service provider.

5.2. The contract for the provision of travel services is between you and the service provider, not between you and us. We act solely as an intermediary facilitating the reservation. The user understands and agrees that the platform is not responsible for the performance of third-party service providers (including service quality, safety, and compliance). However, the platform is obligated to assist users in negotiating and resolving disputes with service providers.

5.3. You acknowledge that we may work with third-party service providers to fulfill your bookings. The services provided by these third parties are subject to their own terms and conditions.

5.4. By making a booking, you warrant that you are at least 18 years of age and possess the legal authority to enter into agreements.

6. Pricing and Payment

6.1. All prices listed on our site are in USD (U.S. Dollars) and include applicable taxes, unless otherwise specified. Certain payment methods (such as international credit cards linked to third-party payment tools) may be subject to restrictions under China’s foreign exchange management policies. Users are responsible for confirming their payment capability. The platform is not liable for booking failures due to payment issues.

6.2. Prices are subject to change without notice prior to confirmation of your booking.

6.3. Payment must be made in full at the time of booking unless otherwise specified.

6.4. We use third-party payment processors to handle all financial transactions. By making a payment, you agree to the terms and conditions of these payment processors.

6.5. Users may not use the platform for fraudulent transactions, money laundering, or other illegal financial activities. The platform reserves the right to suspend suspicious transactions and request identity verification documents from users (such as a passport copy or payment proof). In the event of confirmed fraudulent activity, the platform reserves the right to report the matter to law enforcement authorities.

7. Cancellations and Refunds

7.1. Cancellation and refund policies vary based on the service provider, travel package, and time of cancellation.

7.2. Cancellation policies specific to your booking will be clearly communicated during the booking process and in your confirmation. At the time of booking confirmation, users must explicitly agree to the service provider's refund policy (e.g., 80% refund for cancellations made 30 days before departure, 50% refund within 15 days). If the service provider does not specify a refund policy, the platform's refund policy will apply by default (link or attachment required).

7.3. We reserve the right to charge administrative fees for processing cancellations and refunds.

7.4. No refunds will be issued for no-shows or unused services.

7.5. We strongly recommend purchasing travel insurance to protect against unforeseen circumstances.

8. Travel Documentation and Requirements

8.1. You are solely responsible for obtaining and maintaining all necessary travel documentation, including but not limited to valid passports, visas, health certificates, and insurance.

8.2. We are not responsible for any denial of entry, deportation, or any other consequences resulting from your failure to comply with the travel requirements of China or any transit countries.

8.3. Information provided on our Site regarding travel documentation requirements is for general guidance only and may change without notice. You should always verify current requirements with relevant authorities.

8.4. The user commits to completing the China Customs health declaration independently (via WeChat's "Customs Passenger Fingertip Service" or Alipay's "International Travel Health Declaration" mini-program) and ensures that the declaration information is truthful and valid. The platform and service providers are not responsible for any delays or denial of entry caused by the user's failure to fulfill this obligation.

9. Travel Risks and Insurance

9.1. International travel involves inherent risks. By using our services, you acknowledge and accept these risks.

9.2. We strongly recommend that all travelers obtain comprehensive travel insurance covering medical emergencies, trip cancellation, lost luggage, and other potential travel-related issues.

9.3. We are not responsible for any injuries, illness, damages, losses, accidents, delays, or other irregularities which may be caused by defects in any vehicle, acts or omissions of any service provider, or any other cause beyond our direct control.

9.4. If the itinerary includes cultural experience activities (such as intangible cultural heritage crafts or festival events), the user agrees to accept reasonable alternative arrangements due to weather, policy, or organizer-related reasons, and shall not request compensation for such changes.

10. Force Majeure

10.1. We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause that is beyond our reasonable control.

10.2. Such causes include, but are not limited to: natural disasters, adverse weather conditions, government actions, civil unrest, terrorist attacks, war, strikes, epidemics, pandemics, or other health emergencies.

10.3. In the event of force majeure, we reserve the right to cancel, delay, or modify bookings without liability.

11.2. Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the booking giving rise to such claim.

11.3. "While we act solely as an intermediary platform, we commit to:
a) Conducting basic due diligence on all third-party suppliers to verify their business licenses and operational qualifications;
b) Providing a dedicated dispute resolution channel to assist you in communicating with suppliers;
c) Suspending cooperation with suppliers receiving consistent negative user feedback.
However, we do not guarantee the performance of suppliers and disclaim liability for deficiencies in their services beyond our direct control."

You agree to indemnify, defend, and hold harmless Bambu, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.
